Terms of Service

• Please read these terms of service ("Terms") carefully before using the products and services offered by myPLC. This agreement sets forth the legally binding Terms for your use of the website at https://www.taskbundler.com (the "Site"). YOU ACKNOWLEDGE AND AGREE THAT, BY ACCESSING OR USING THE SITE, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SITE. If you are entering into this agreement on behalf of a company or legal entity you represent, you bind such entity to these Terms. In which case, the terms "you" or "your" shall refer to such entity.

• myPLC accounts are available for educators, teachers, professors, administrators, and others who are similarly involved in education ("Educators") who are at least 18 years old. If you are not an Educator or are under 18, you may not create an account.
• During the registration process, you must provide your email address and create a password. We recommend that you create strong passwords that use a combination of upper and lower case letters, numbers and symbols. myPLC cannot and will not be liable for any loss or damage to your account due to your failure to maintain your email and password.

• myPLC is free for individual teachers. Schools or districts may pay for team access and/or student access. Fees are non-refundable.
• There are no fees for non-registered users ("Guests"), typically the students and parents being served by a registered user. Guests do not need to create an account to access a course in myPLC.

• You may cancel your account at any time by simply clicking the "Cancel" button in your Account.
• myPLC, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Site for any reason at any time. Such termination of your account will result in the deactivation or deletion of your account and/or access to your account, and the forfeiture and relinquishment of all content in your account. myPLC reserves the right to refuse service to anyone for any reason at any time.

• Your content is your property. myPLC claims no intellectual property rights over the content you provide to the Site.
• myPLC does not represent or imply that it endorses the content posted to the Site or that it believes such material to be accurate, useful or non-harmful.
• We do not pre-screen content, but have the right (not the obligation) in our sole discretion to refuse or remove any content that you add to the Site. If you believe that content posted on the Site infringes or misappropriates the intellectual property rights of a third party or violates applicable law, please contact us at contact@taskbundler.com.
• You agree that you are responsible for the content you create while using the Site and for any consequences thereof. Further, you agree to defend myPLC against any claim, demand, suit or proceeding made or brought against myPLC by a third party alleging that your content, or your use of the Site in violation of this agreement, infringes or misappropriates the intellectual property rights of a third party or violates applicable law, and shall indemnify myPLC for any damages finally awarded against, and for reasonable attorney’s fees incurred by myPLC in connection with any such claim, demand, suit or proceeding.

• The Site may contain links to third-party websites. You acknowledge and agree that we are not responsible or liable for: (i) the availability or accuracy of such websites; or (ii) the content, products, or services on or available from such websites. Links to such websites do not imply any endorsement by myPLC of such websites or the content, products, or services available from such websites. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites.

• myPLC actively solicits users to share feedback and comment about our products and services and to share ideas for new products and services ("Suggestions"). Any Suggestions you share are entirely voluntary and we will be free to use your ideas, feedback, comments or suggestions as we see fit and without any obligation to you.

• You agree that when using the Site, you will not:
• 1. Share your account with someone else. A single account shared by multiple people is not permitted;
• 2. Impersonate another person or entity;
• 3. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
• 4. Remove any copyright, trademark or other proprietary rights notices contained in or on the Site;
• 5. Reproduce, duplicate, copy, sell, resell or exploit any portion of the Site;
• 6. Submit content that falsely expresses or implies that such content is sponsored or endorsed by myPLC;
• 7. Promote or provide information about illegal activities or promote physical harm or injury against any department or individual;
• 8. Use the Site for any illegal or unauthorized purpose;
• 9. Transmit any worms or viruses or any code of a destructive nature;
• 10. Modify, hack, or engage in any activity that interferes with or disrupts the Site (or the servers and networks which are connected to the Site);
• 11. Access (or attempt to access) the Site's administrative interface unless you have been specifically allowed to do so in a separate agreement with myPLC.

• You understand that myPLC uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Site. Further, you understand that the technical processing and transmission of the Site, including your content, involves transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices.
• The Site is provided on an “as is” and “as available” basis. myPLC does not warrant that (i) the Site will meet your specific requirements; (ii) the Site will be uninterrupted, timely, secure, or error-free; (iii) the results that may be obtained from the use of the Site will be accurate or reliable; (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Site will meet your expectations; and (v) any errors in the Site will be corrected.
• You understand and agree that myPLC shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if myPLC has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Site; (ii) the cost of procurement of substitute products or services resulting from any products or services purchased or obtained or messages received or transactions entered into through or from the Site; (iii) unauthorized access to or alteration of your content or data; (iv) statements or conduct of any third party on the Site; (v) or any other matter relating to the Site.
• myPLC reserves the right at any time to modify or discontinue, temporarily or permanently, the Site (or any part thereof) with or without notice.
• The Site is protected by copyright, trademark, and other laws of both the United States and foreign countries. All right, title, and interest in and to the Site (excluding content provided by users) are and will remain the exclusive property of myPLC. Nothing in the Terms gives you a right to use the myPLC name or any of the myPLC trademarks, logos, domain name, and other distinctive brand features.
• The failure of myPLC to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms constitute the entire agreement between you and myPLC and govern your use of the Site, superseding any prior agreements between you and myPLC (including, but not limited to, any prior versions of the Terms of Service). You agree that these Terms and your use of the Site are governed under California law. All claims, legal proceedings or litigation arising in connection with the Sites will be brought solely in Sacramento County, California, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.

• myPLC reserves the right to update and change these Terms without notice. Any new features that augment or enhance the current products and services shall be subject to the Terms. Continued use of the Site after any such changes shall constitute your consent to such changes.
• We will notify you about significant changes in these terms by sending a notice to the email address specified in your account or by placing a prominent notice on the Site. You can review the most current version of these Terms at any time at https://www.taskbundler.com/terms.
